These terms apply to your use of www.creatorhai.com (the "Website") and to the creator discovery and marketing services offered by CreatorHai ("CreatorHai", "we", "us"). By using the Website you agree to these terms. If you do not agree, please do not use it.

1. What CreatorHai does

CreatorHai helps brands and agencies discover content creators, and helps creators become easier to find for brand collaborations. We also offer managed services such as campaign management, creator sourcing, content production, social media management, paid social and consulting.

2. Using the Website

You agree to use the Website lawfully and not to:

• give false or misleading information about yourself, your brand or your content;
• copy, scrape or resell Website content or creator information without our written permission;
• interfere with the Website's operation or security, or try to gain unauthorised access;
• use the Website to send spam, harass others or break any law.

3. Information on the Website

Creator profiles, audience sizes and campaign descriptions are provided for general information. Audience figures are approximate and are provided by creators unless we state otherwise. We take care to keep the Website accurate but do not promise that everything is complete or current.

4. Enquiries and services

Contacting us does not create a contract. Managed services and any fees, deliverables and timelines are agreed in writing, by email or a service agreement, before work begins. Pricing depends on the brief.

5. Collaborations between brands and creators

Where we introduce a brand to a creator, the collaboration terms, including deliverables, usage rights, timelines and payment, are agreed between the brand and the creator, unless we are managing the campaign for you under a written agreement. We do not guarantee that a creator will accept a collaboration or that a campaign will achieve a particular result, such as reach, sales or sign-ups.

6. Advertising and disclosure rules

Brands and creators are responsible for following applicable advertising law and guidelines, including the Advertising Standards Council of India (ASCI) guidelines for influencer advertising and the Consumer Protection Act, 2019. Sponsored content must be clearly disclosed. Content about financial products, health or other regulated topics must also follow the rules of the relevant regulator.

7. Content and intellectual property

The Website, its design, text, graphics and logo belong to CreatorHai or its licensors and are protected by law. You may view and share the Website for personal or internal business use, but may not copy or reuse it commercially without permission.

Creators keep ownership of their content. If a brand wants to reuse a creator's content, such as in ads or on its own channels, the usage rights, duration and fees must be agreed in writing between them.

8. Third-party platforms and links

Creators publish on third-party platforms such as Instagram and YouTube, and the Website may link to other sites. We do not control those platforms or sites, and their own terms apply. We are not responsible for their content or availability.

9. Disclaimer

The Website and our discovery information are provided "as is" and "as available". To the fullest extent allowed by law, we do not give any warranty, express or implied, including about fitness for a particular purpose or uninterrupted availability.

10. Limitation of liability

To the fullest extent allowed by law, CreatorHai will not be liable for any indirect, incidental or consequential loss, or for loss of profits, revenue, data or goodwill, arising from your use of the Website or from a collaboration between a brand and a creator. Where we provide paid services under a written agreement, our total liability is limited as set out in that agreement. Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You agree to compensate CreatorHai for losses and claims arising from your breach of these terms, your misuse of the Website, or content or materials you provide that infringe another person's rights.

12. Privacy

How we handle personal information is explained in our Privacy Policy.

13. Suspension and termination

We may restrict or end your access to the Website, or decline to work with you, if you break these terms or if we need to do so to comply with the law.

14. Changes to these terms

We may update these terms from time to time. The "last updated" date above shows the latest version. Continuing to use the Website after a change means you accept the updated terms.

15. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the competent courts in India.
